1. Who We Are
Creative Pixel ("Creative Pixel," "we," "us," or "our") is a sole proprietorship operated by Reginald Guilford Griffin, doing business as "Creative Pixel," based at 425 West Colonial Drive, Suite 101, Orlando, Florida 32804. Creative Pixel operates three lines of business, all covered by these Terms:
- AI Made Simple — an online course teaching individuals and small businesses how to use AI, sold at https://creative-pixel.com.
- Creative Pixel Automation — a managed service in which Creative Pixel connects to a client's own TikTok, Shopify, Pinterest, and/or Instagram accounts (via each platform's official API and authorization flow) to perform social media and e-commerce management tasks on the client's behalf.
- Website Design & Build — custom website design, development, and launch services for a client's business.
By purchasing the course, engaging Creative Pixel Automation or our website design and build services, or otherwise using our website, you agree to these Terms.
2. Eligibility
You must be at least 18 years old to purchase the course or engage our other services. If you are engaging Creative Pixel Automation or our website design and build services on behalf of a business, you represent that you have the authority to bind that business to these Terms and, for Automation clients, to authorize Creative Pixel's access to the business's connected platform accounts.
3. The AI Made Simple Course
3.1 Enrollment & Payment
Course fees are as stated on our pricing page at the time of purchase and are processed by a third-party payment processor [PAYMENT PROCESSOR — not yet finalized; placeholder]. Creative Pixel does not directly collect or store your full payment card details — see our Privacy Policy for how payment information is handled.
3.2 Access & License
Upon payment, we grant you a personal, non-exclusive, non-transferable license to access the course materials for your own individual or, for Business-track purchases, internal business use. You may not resell, redistribute, publicly share, or use course materials to create a competing product or service.
3.3 Refunds
We offer a full refund if requested within 30 days of your purchase date. To request a refund, contact us at contact@creative-pixel.com.
3.4 Add-Ons
1:1 coaching sessions and custom AI agent builds are sold separately from the core course tiers and are subject to their own scope, scheduling, and payment terms, which will be confirmed with you directly before work begins.
4. Creative Pixel Automation Services
4.1 What the Service Does
Creative Pixel Automation connects to platform accounts that you own or are authorized to manage — currently TikTok, Shopify, Pinterest, and Instagram — using each platform's official developer API and its standard authorization flow (for example, OAuth). Once connected, Creative Pixel may, within the scope you authorize, take actions on your behalf such as publishing or managing content, updating product listings and images, and similar account-management tasks, with or without an active human review step depending on the service tier you engage.
4.2 Your Authorization & Responsibilities
By connecting an account to Creative Pixel Automation, you:
- Confirm you are the account owner or are authorized by the account owner to grant this access;
- Authorize Creative Pixel to access and act on that account within the scope of the services you've engaged us for;
- Remain responsible for the underlying account's compliance with that platform's own terms of service and community guidelines — Creative Pixel acts as your agent, not as a shield from platform-level enforcement against your account;
- Can revoke Creative Pixel's access at any time, either directly through the connected platform's own account/app-permissions settings, or by written request to us — see Your Choices in our Privacy Policy.
4.3 No Platform Affiliation
Creative Pixel is an independent business and is not affiliated with, sponsored by, or endorsed by TikTok, Shopify, Pinterest, or Meta/Instagram. TikTok, Shopify, Pinterest, Instagram, and their respective logos are trademarks of their respective owners.
4.4 Fees
Fees for Creative Pixel Automation are agreed with each client individually (one-time build fee, recurring management fee, or a combination) and are set out in a separate order, invoice, or statement of work rather than a fixed public price list, given the variation in scope between clients.
4.5 No Guarantee of Platform Outcomes
Creative Pixel does not control TikTok, Shopify, Pinterest, Meta/Instagram, or any other third-party platform, and cannot guarantee any particular outcome (reach, sales, account standing, or approval status) resulting from our services. Platforms may change their APIs, policies, or enforcement at any time, which may affect the automation services we can provide.
5. Website Design & Build Services
5.1 Scope of Work
Each website design and build engagement is scoped individually in a written proposal, quote, or statement of work agreed with you before work begins, covering deliverables, timeline, and the number of revisions included. Work outside that agreed scope may require a separate quote.
5.2 Client Materials & Cooperation
You are responsible for providing, in a timely manner, the content, brand assets (such as logos, images, and copy), feedback, and any account access (for example, domain registrar, hosting, or CMS access) needed to complete and launch your project. Delays in providing these may delay your project's timeline.
5.3 Ownership & License
Once you've paid in full, you own the final delivered website design and the content created specifically for your project. Creative Pixel retains ownership of its own general-purpose code, tools, templates, and know-how developed independent of your specific engagement, and may reuse them in other projects. Any third-party assets, plugins, or platforms used in your site remain subject to their own separate licenses.
5.4 Hosting, Domains & Third-Party Services
If Creative Pixel sets up hosting, domain registration, or other third-party services on your behalf or using access you've provided, you remain the account owner and the party responsible for that relationship and its fees, unless we've agreed otherwise in writing.
5.5 Fees
Fees for website design and build services are set per project in the agreed proposal or quote (a one-time build fee, an ongoing maintenance fee, or both), rather than a fixed public price list, given the variation in scope between projects.
5.6 Post-Launch Support
Unless otherwise agreed, ongoing maintenance, hosting, updates, or support after your site launches are separate from the initial build and offered under their own terms.
6. Acceptable Use
You agree not to use our website, course, or other services to:
- Violate any applicable law or the terms of service of any connected platform;
- Post or facilitate posting of unlawful, infringing, or deceptive content;
- Attempt to manipulate engagement metrics in a way that violates a platform's policies (e.g., spam, fake engagement);
- Interfere with or disrupt the integrity or performance of our services or any connected platform's systems.
We may suspend or terminate services for any client found to be in violation of this section.
7. Intellectual Property
All course content, website content, and Creative Pixel branding are owned by Creative Pixel or its licensors and are protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of that content to you beyond the limited license described in Section 3.2, or the website design ownership described in Section 5.3.
8. Disclaimers
The course and our other services are provided "as is" and "as available." We make no warranty that the course will meet your specific goals, that automation services will be uninterrupted, error-free, or free of platform-side disruptions outside our control, or that a website we design and build will achieve any particular business outcome.
9. Limitation of Liability
To the maximum extent permitted by law, Creative Pixel will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the course or our other services, including lost profits, lost sales, account suspension by a third-party platform, or website downtime. Our total liability for any claim arising from these Terms will not exceed the amount you paid to Creative Pixel in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold Creative Pixel harmless from any claim, loss, or damage (including reasonable legal fees) arising from your breach of these Terms, your violation of a connected platform's terms, your lack of authorization to grant us access to a connected account, or content or materials you provide us for a website design and build project.
11. Termination
You may stop using our services and revoke platform connections at any time. We may suspend or terminate your access to the course or our other services for violation of these Terms, non-payment, or as required by a connected platform's policies.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, and any dispute arising under them will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Effective date" above. Continued use of our course or other services after changes take effect constitutes acceptance of the revised Terms.
